I believe that the copyright act allows a copy for fair review purposes, and so if you used the picture as part of a review article, and I would argue tht all articles in MM are review, you can probably get away with an acknowlegement of source. Otherwise for the all the academic articles I write I would be chasing copyright forever.
Normally when I ask and say it is a for a not for profit publication they say fine as long as I put something like {By permission of the National Library of Australia.). That happened last week when a reviewer objected to me using a US photograph I had taken and I needed one from the National Library and they have a simple form, the response came the next day.
I have sent for the bird book by ILL and I will at least put the picture in question up on my web site with a comparsion to the GN picture - if'n Ed will send me on of his superb photographs as I do not own GN.
