What a perceptive contribution Ed!
Here in the UK we are faced with a nonsense law referred to as a 'right to roam' the idea being that anything not a town can be walked over by all and sundry with no thought that the land my be owned by somebody. I was brought up in the country so am all too aware of the fact, unfortunately laws are made by people brought up in towns who seem to think that anything without houses on is some kind of glorified park. A farmer friend of my father's when he came across people having a picnic on his land used to request their address, when they asked why he told them that he would come and picnic on their front lawn!
The answer to your actual question Ed is 'Yes', but often 'who' is much harder to answer.
