BTW, I quuite like the following thought of Callinan and Heydon JJ in Vairy when dealing with the argument that the Council should have prohibited diving into the sea from the rocks:

"There is a further reason why a prohibitory sign was not warranted. It is that authorities should not lightly criminalize recreational conduct, particularly conduct, unlike that of the motorist driving too close to the preceding vehicle, which is unlikely to harm others. Even in times of increasing intrusions by governments and local authorities upon personal autonomy, some degree of latitude of choice in conduct must be allowed. "
