There's another element in all this - common land. Much of what we now know as the Lakeland Fells was, and in many cases still is, common land, i.e. land over which the local community have rights of grazing, woodgathering etc. The law of commons is ancient and complicated, but it is still alive. Place names reflect this, e.g. Torver Common (frequently referred to by Tony Richards on Lakelandcam). The most frequent activity on commons nowadays is the grazing of sheep, but over the years territories ('hefts') have been established for each owner. It is doubful whether mining would ever be regarded as lawful on common land, but you would need a local lawyer/historian to sort that one out.
