Sorry Jim you have slightly missed my point - the garden example was an old story from my family to try to impress upon visitors to the country that a seemingly public open space like a field is actually owned by somebody, and that they would like to be asked before people start using it; just as you would if someone wanted to go in your garden to retrieve a lost ball etc. No matter how land ownership came about, all land is owned by somebody, individual or organisation, and access for whatever reason should be by co-operation with the owners not through a law that appears to this layman to not take their ownership into account.
