Jock, haven't you got you corporations back to front? Isn't it the 'active' part of any society that needs the protection that limited liability offers? I agree with you that limited liability aids the work of a 'trading arm' by giving it a corporate identity that allows the trading that could otherwise be difficult, but isn't that very same corporate indentity crucial when it comes to possible negligence?
A distinction also has to be made between the requirements of Company Law, which makes no mention of safety, and the requirements of common sense, a point so obviously confused by Ms Hardyment in her recent Mixed Moss article.
