It must have been a common rule of land allocation in British colonies, because we have a similar distance round our lakes in Ontario which was reserved by the Crown. More recently, the Crown has sometimes sold off its ownership so that cottage owners can enjoy their waterfront property (and be heavily taxed for it) without people strolling along in front of them. However, there are still many places where it is Crown land.
Private ownership does not mean thatyou can prevent a distressed mariner from seeking refuge on any shore that he can reach.
