It was a cigar, lit by Captain Flint, and left LIT during a refueling operation that started the fire, therefore leaving room for a claim of dereliction of duty and negligence leading to the destruction of the ship. He should have pitched that cigar overboard before attempting to move fuel. It was his failure to do so that caused the loss.

In general, the Captain bears the ultimate responsibility for whatever happens on his ship. That is why he has certain RIGHTS that may seem dictatorial, as he also has that responsibility.

Not that I am a lawyer, but just an opinion.
