Yes, it's the same here in Oz too. My place in Cannons Creek abuts the waters of Western Port, but there's still a strip of Crown Land (whose grass I used to mow) between the back fence and the waterway. Anyone can use it for recreation -- although in fact few do because the track that's there peters out into pretty-well impassable mangroves a couple of hundred yards past my place.
