I suspect it was a result of non-sailing (and I include powerboaters in "non-sailing") delegates and legislators being unable to fathom

  1. why a close-hauled sailboat would be less free to maneuver than one with the wind aft and
  2. that the vessel to windward and running or reaching won't always be on the same tack as the close-hauled vessel.
